Condominium  (Condominium Apartments & Condominium Townhouses)

A Survey Clause in Agreement of Purchase and Sale is NOT NEEDED since condo plan surveys are ALWAYS on file in the land registry system and are too bulky for dealing with copies in processing a sale transaction.

For Non-Condominium Properties (Detached, Semi-Detached, Link & Freehold Town Homes)

If a purchaser obtains title insurance, the need for a survey may be eliminated. However, a clause in the Agreement of Purchase and Sale requires the vendor to provide an existing or an updated survey.

If the Purchaser later on wants to make additions or improvements to the property, the Survey is important as it shows location of lot boundaries, lot size, location of building on the lot, setbacks, encroachments, easements, etc. which can be reviewed by the purchaser’s lawyer when doing the legal processing for the purchase.
